Kototap Terms of Service

1. Eligibility and availability

You must be at least 18 years old and legally capable of entering a contract to use Kototap. The initial public version of Kototap is offered only in the United States. You may use the Service only where it is lawfully available and in compliance with these Terms and applicable law.

2. Accounts

An account is required to use Kototap. You must provide accurate information, keep your sign-in credentials secure, and promptly notify us of suspected unauthorized access. You are responsible for activity under your account and may not sell, transfer, or share it with another person.

You can delete your account under Settings → Account → Delete Account or follow the instructions on our account-deletion page. Account deletion is permanent and may cause you to lose remaining access, progress, and generated stories.

3. The Service and AI-generated content

Kototap provides adaptive Japanese reading practice, including AI-generated stories, translations, annotations, audio, progress tracking, and review features. Features and content may change over time, and we do not promise that any particular feature or content will always be available.

AI-generated and automatically analyzed content may be inaccurate, incomplete, offensive, or otherwise unsuitable. It is provided for general language-learning purposes and is not authoritative advice. Do not rely on Kototap for legal, medical, financial, safety-critical, or other high-stakes decisions. You are responsible for evaluating content before relying on or sharing it.

4. Subscriptions, trials, and billing

• Kototap offers one monthly, auto-renewing subscription. The initial U.S. price is approximately $20 per month, but the exact price, currency, taxes, and billing terms displayed by Apple or Google when you subscribe control.
• Eligible new subscribers may receive a seven-day free trial. Trial eligibility is determined by the applicable app store and may be limited to one introductory offer per subscription group or account.
• Unless you cancel before the trial ends, the store will automatically charge the displayed monthly price when the trial ends. The subscription then renews automatically each month until canceled.
• Except for an active trial, beta access, or a separate promotion, Kototap currently has no free tier. Access ends when you do not have an active subscription.
• Apple or Google processes payment and manages renewal, cancellation, and refunds under its applicable account terms and store rules. RevenueCat helps us coordinate subscription status but does not process your full payment-card details for us.

You can manage or cancel through your Apple App Store or Google Play subscription settings. Cancellation prevents future renewal but ordinarily takes effect at the end of the current paid period. Except where law or the applicable store policy requires otherwise, payments are non-refundable and we do not provide credits for a partially used billing period. Apple refund requests must be submitted to Apple. Google Play refund requests may be submitted to Google or, when Google directs, to us; we may grant a discretionary Google Play refund for issues such as duplicate charges or a confirmed technical failure.

Deleting your Kototap account or uninstalling the app does not cancel your store subscription. If you delete your account while subscribed, billing may continue until you separately cancel through Apple or Google, and you may lose access to the remaining subscription period.

Family Sharing is not supported. We may offer beta access, discounts, free months, offer codes, or complimentary access. Additional terms presented with a promotion control its eligibility, duration, price, renewal, and other details.

5. Limited license and generated stories

Subject to these Terms and an active right to access the Service, Pounce Studio grants you a limited, personal, nonexclusive, nontransferable, nonsublicensable, and revocable license to use Kototap for your own noncommercial language learning.

You may save and share stories generated for you for personal, noncommercial purposes. You may not sell them, bulk scrape or systematically extract them, republish them as a library or competing product, remove notices, or use them to train or improve another AI system. This permission does not grant rights in third-party material that may appear in generated output, and you are responsible for how you use or share the output.

6. Acceptable use

You may not:

• use the Service unlawfully or violate another person’s rights;
• interfere with, disrupt, overload, probe, or bypass the Service or its security and access controls;
• access the Service through unauthorized automation, scraping, bots, or bulk-download methods;
• copy, modify, reverse engineer, decompile, or attempt to derive source code except to the limited extent applicable law expressly permits;
• resell, sublicense, rent, or commercially exploit the Service;
• use Kototap content or output to develop, train, benchmark, or improve a competing product or AI system; or
• introduce malware, impersonate another person, or use the Service for fraud, abuse, or unauthorized access.

7. Your submissions and feedback

Kototap does not currently provide public posting or user-to-user content features. If you send support material, feedback, or other input, you keep any rights you already have in it and grant Pounce Studio a worldwide, nonexclusive, royalty-free license to host, copy, process, modify, and use it as reasonably necessary to provide, secure, support, and improve the Service. If you provide an idea or suggestion, we may use it without restriction or compensation to you.

8. Pounce Studio intellectual property

The Service, including its software, design, branding, databases, selection and arrangement of content, and other technology, is owned by Pounce Studio or its licensors and is protected by law. Except for the limited permissions expressly granted in these Terms, no rights are transferred to you.

9. Third-party services and app stores

Kototap relies on third-party services, including authentication, cloud, AI, analytics, app-store, and payment services. Their terms may apply to your use of their products, and we are not responsible for third-party services outside our control.

For an iOS download, Apple’s standard Licensed Application End User License Agreement applies, and these Terms supplement it. If these Terms conflict with Apple’s standard EULA on a matter governed by that EULA, the standard EULA controls. Your use of an Android download is also subject to applicable Google Play terms.

10. Privacy and communications

Our Privacy Policy explains how we handle information. You agree that we may send transactional and service communications about authentication, security, subscriptions, account deletion, and material Service or policy changes. Marketing email and marketing push notifications require a separate choice and can be turned off without ending necessary service communications.

11. Suspension and termination

You may stop using Kototap or delete your account at any time. We may suspend or terminate access if you materially violate these Terms, create risk or legal exposure, fail to pay applicable charges, or if we discontinue the Service. Where practical, we will provide notice and an opportunity to address the issue. Sections that by their nature should survive termination will survive, including ownership, disclaimers, liability limits, and dispute terms.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” POUNCE STUDIO DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

We do not guarantee any particular language-learning outcome, proficiency level, content accuracy, feature availability, or compatibility with a particular device. Some jurisdictions do not allow certain warranty disclaimers, so some of this section may not apply to you.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POUNCE STUDIO AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID FOR KOTOTAP IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

These limitations do not apply to liability that cannot legally be limited or excluded, and they do not waive non-waivable consumer rights.

14. Governing law and disputes

New York law governs these Terms, without regard to conflict-of-law rules, except to the extent mandatory law provides otherwise. You and Pounce Studio consent to exclusive jurisdiction and venue in the state and federal courts serving Albany County, New York, for disputes arising from these Terms or the Service, subject to any non-waivable right to bring a claim in another forum.

These Terms do not require mandatory arbitration and do not include a class-action waiver.

15. Changes to these Terms

We may update these Terms as Kototap changes. We will post revised Terms, update the effective date, and provide additional notice when a material change requires it. If you do not agree to revised Terms, you must stop using Kototap. Your continued use after revised Terms take effect means you accept them to the extent permitted by law.

16. General terms

These Terms and the documents they incorporate are the entire agreement between you and Pounce Studio about the Service. If a provision is unenforceable, it will be modified only as much as needed and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them in connection with a reorganization, financing, merger, acquisition, or sale of assets.
